1. These gift card terms and conditions (“Gift Card T&Cs”) set out the legal terms and conditions which apply to your purchase and use of Gousto physical and digital gift cards. Gousto’s Terms & Conditions For Sale of Goods found on Gousto’s website here will apply to the purchase of Gousto gift cards, and by purchasing a Gousto gift card you acknowledge that you are also bound by those general terms and conditions. Unless otherwise defined herein, all defined terms in Gousto’s Terms & Conditions For Sale of Goods shall have the same meanings as in these Gift Card T&Cs.
2. These Gift Card T&Cs apply to your Gousto gift card and govern the relationship between us and you. Gousto reserves the right to update and change these Gift Card T&Cs at any time. This does not affect your legal rights. Use of a Gousto gift card constitutes acceptance of these Gift Card T&Cs. We, therefore, recommend you read these Gift Card T&Cs carefully. It is your responsibility to check these Gift Card T&Cs from time to time to ensure you are aware of any changes which may have been made.

4. These Gift Card T&Cs apply to pound sterling (GBP) Gousto gift cards purchased online through our third party gift card purchase provider.
5. Gousto gift cards remain the property of Gousto who maintains the right to cancel the gift card in its sole discretion in situations where it is deemed necessary to do so (such as to comply with applicable laws or as a result of circumstances beyond its control).
6. You will be provided with a unique link in order to redeem your Gousto gift card online. The unique link will take you to a Gousto landing page and your gift card shall be applied automatically. The unique link must be used and you will not be able to redeem your gift card on Gousto’s standard customer page. Once on the unique landing page you will complete the customer sign up process (or log into your existing customer account) and purchase your order. You may use your Gousto gift card to pay for the whole or any part of an order subject at all times to the value on the gift card. The Gousto gift card can therefore be supplemented with other methods of payment if the products purchased exceed the balance on the gift card.
7. If the value of your order exceeds the value of the gift card, Gousto will calculate the remaining balance at checkout which you will only be able to pay using a valid debit or credit card. If the value of your order is less than the value of the gift card, you will lose any credit not used for the order and you will therefore not be able to redeem any of your credit balance on your next purchase.
8. You must redeem your gift card within the period that is 3 months from the date of issue (the “Redemption Period”). If you do not use your Gousto gift card within the Redemption Period, your Gousto gift card will automatically expire and cease to be valid and any remaining credit value stored on it will expire. Expired value cannot be transferred to a new card or be redeemed. Gousto has no obligation to remind or inform you of your gift card’s expiry and it is your sole responsibility to ensure that any balance is used in full prior to expiry. A Gousto gift card expires automatically once its balance has been exhausted. It is not possible to top up an exhausted Gousto gift card.
9. The gift card balance cannot be exchanged for cash or redeemed against the purchase of another card.
10. You are solely responsible for the safekeeping and security of your Gousto gift card. In cases where your Gousto gift card is lost or stolen, Gousto is unfortunately unable to replace or reimburse any of the remaining balance on your gift card. Gousto is not responsible for any balance lost on a Gousto gift card as a result of loss or unauthorised use of the gift card or any theft or fraud.
11. When you use a Gousto gift card you warrant to us that you are the authorized recipient of the gift card and that you are using it in accordance with these Gift Card T&Cs. If Gousto believes in our sole discretion that a Gousto gift card is being used in breach of these Gift Card T&Cs or otherwise being used unlawfully or in bad faith, we reserve the right to reject or cancel the gift card.
12. Gousto is not liable for any act, error, omission or default resulting directly or indirectly from any cause beyond our control, including but not limited to, failure of network services and failure of data processing systems. To the extent permitted by law, all conditions or warranties implied by law, statute or otherwise are expressly excluded. Gousto will not be liable to you for any loss of income, business, goodwill or profits arising out of your use of the Gousto gift card or these Gift Card T&Cs. Gousto will not be liable for any unauthorised access to or alteration, loss, theft or destruction of your Gousto gift card.
13. We are not liable for any failure to perform or delay in performing any obligation under these Gift Card T&Cs if the failure or delay is caused by any circumstances beyond our reasonable control including any act, omission, error or failure of any third party.
14. You acknowledge and agree that we may process your personal data in accordance with current applicable data protection legislation and the terms of our privacy and cookies policy which is subject to change from time to time.
15. Gousto reserves the right to amend or waive any provision of these Gift Card T&Cs from time to time and at any time, or to terminate the Gousto gift card program on reasonable notice.
16. These Gift Card T&Cs are governed by and construed in accordance with the laws of England and Wales. Gousto and you both agree to submit to the exclusive jurisdiction of the English courts.
